Smartivity Inc operates the Smartivity USA store and the website smartivity.com, including all related information, content, features, tools, products and services, in order to sell our products to you (the "Services"). Smartivity USA is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit, use, or make a purchase or other transaction using the Services or otherwise communicate with us. If we publish Terms of Service and they conflict with this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.
Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described in this Privacy Policy.
Personal Information We Collect or Process
When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:
- Contact details including your name, address, billing address, shipping address, phone number, and email address.
- Financial information including credit card, debit card, and financial account numbers, payment card information, financial account information, transaction details, form of payment, payment confirmation and other payment details.
- Account information including your username, password, security questions, preferences and settings.
- Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel and your past transactions.
- Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry.
- Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
- Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.
Product Registration and Free Part Requests
Register your kit
If you register a kit on our site, we ask for your name, your email address, which kit you have and where you bought it. You can also give the purchase date, the order number and one photo of your receipt or the box. Those three are optional. We use these details to keep a record of your registration. This form is for adults.
We add your email address to our marketing list only if you check the box that asks for this.
Free Parts Replacement
If you ask for a free part through the form on our site, we ask for your name, email address, phone number, shipping address, which kit you have, what happened, the part name and quantity, the sheet number and one photo of the part. Where you bought the kit, the box code and notes are optional. We use these details to handle your request.
Where we keep it and who can see it
We save what you enter in a Google Sheet. We also save the date and time, a reference number and, for a registration, whether you checked the email box. We save your photo in a private Google Drive folder. Both are in a Google Workspace account that our team uses. A part request also reaches us as an email.
Team members who have access to the Google Sheet can see these details. The team that handles these requests works from India.
How long we keep it
We have not set a fixed time limit. We keep these details while we need them to handle your registration or request and to keep a record of it, or longer if the law requires.
How to see, change or delete it
Email support@smartivity.com from the email address you used on the form. Tell us what you want to see, change or delete. We will look for your entry, and your photo if you sent one, and reply to you.
Personal Information Sources
We may collect personal information from the following sources:
- Directly from you including when you create an account, visit or use the Services, communicate with us, or otherwise provide us with your personal information;
- Automatically through the Services including from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies;
- From our service providers including when we engage them to enable certain technology and when they collect or process your personal information on our behalf;
- From our partners or other third parties.
How We Use Your Personal Information
Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:
- Provide, Tailor, and Improve the Services. We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill your orders, to remember your preferences and items you are interested in, to send notifications to you related to your account, to process purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, to facilitate any returns and exchanges, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases. This may include using your personal information to better tailor and improve the Services.
- Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, and, when we run online ads, to show you advertisements for products or services on the Services or other websites, including based on items you previously have purchased or added to your cart and other activity on the Services.
- Security and Fraud Prevention. We use your personal information to authenticate your account, to provide a secure payment and shopping experience, detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity, protect public safety, and to secure our services. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password or other access details with anyone else.
- Communicating with You. We use your personal information to provide you with customer support, to be responsive to you, to provide effective services to you and to maintain our business relationship with you.
- Legal Reasons. We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or actual litigation, or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.
How We Disclose Personal Information
In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:
- With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).
- With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites. - When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products.
- With our affiliates or otherwise within our corporate group.
- In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.
Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes. Depending on where you live, you may exercise certain rights with respect to your personal information at the Shopify Privacy Portal.
Tools on Our Site
Our site uses cookies, device identifiers and similar technologies. These companies' tools run on our site:
- Shopify. Shopify hosts our store, handles payments and sends our emails. These include a welcome email with a discount code when you sign up for our emails, and a reminder if you leave a checkout unfinished. See "Relationship with Shopify" above.
- Google Analytics. We use Google Analytics to measure visits. It uses cookies and similar identifiers to collect information such as the pages you view, your device and browser, and your approximate location. See How Google uses information from sites or apps that use our services.
- Google & YouTube. The Google & YouTube app has a pixel on our site. It can send your shopping activity to Google, such as adding to cart, starting checkout and buying. It may also send contact details from checkout in a scrambled form. Google may use this to measure and show ads. Our pages also load a code file and fonts from Google's servers, so Google receives your IP address.
- Microsoft Clarity. We use Microsoft Clarity to see how people use our site. It records clicks, scrolling and mouse movement, and lets us replay visits and view heatmaps. Microsoft collects this information, which can include personal data, from your browser using cookies and similar technologies. Microsoft receives it to provide Microsoft Advertising and may use it for its own purposes, including advertising. See the Microsoft Privacy Statement.
- Klaviyo. A Klaviyo script loads on every page. It can set a cookie and record the pages you view.
- Judge.me. Judge.me runs our product reviews. If you write a review, your name, email address, review and any photos go to Judge.me. Your review and display name are shown publicly. Judge.me also runs a pixel on our site. It can get your name, email address and order details from our store when you buy, and it may email you to ask for a review.
- IP address lookup. When a page loads, our site sends your IP address to IPinfo (ipinfo.io) to find your country. We use this to send visitors in India to the Smartivity India store, smartivity.in. Our pages also send your IP address to two other lookup services, api.ipify.org and freegeoip.app.
- Other apps. Code from two more apps loads on our pages: a form app (Powerful Form Builder, by Globo) and a redirects app (Easy Redirects).
These companies may collect information about what you do online over time and across different websites. Some may use it for their own purposes, including advertising. Your choices are in "Your Choices About Tracking and Advertising".
Third Party Websites and Links
The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.
Some pages on our site link to forms on the Smartivity India store, smartivity.in, for example for wholesale inquiries. What you enter there is sent through that website, not through this one.
Children's Data
The Services are not intended to be used by children, and we do not knowingly collect personal information from children under 13. Our store is for adults who buy for children. Our registration, part request, contact and email sign-up forms do not ask for a child's name, age or date of birth. Please do not send us personal details of children. If we learn that a child under 13 has sent us personal information, we will delete it. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted. As of the effective date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) personal information of individuals under 16 years of age.
Security and Retention of Your Information
Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.
How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.
Your Rights and Choices
Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.
- Right to Access / Know. You may have a right to request access to personal information that we hold about you.
- Right to Delete. You may have a right to request that we delete personal information we maintain about you.
- Right to Correct. You may have a right to request that we correct inaccurate personal information we maintain about you.
- Right of Portability. You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
- Right to Opt out of Sale or Sharing for Targeted Advertising. Depending on where you reside, you may have a right to opt out of the "sale" or "share" of your personal information or to opt out of the processing of your personal information for purposes considered to be "targeted advertising", as defined in applicable privacy laws. If you visit our website from one of those states with the Global Privacy Control opt-out preference signal turned on, it is treated as an opt-out request for the browser you are using, with the same limits as that page. - Managing Communication Preferences. We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

To opt out, use our Your privacy choices page or the other choices in "Your Choices About Tracking and Advertising" below. To learn more about how Shopify uses your personal information and any rights you may have, including rights related to data processed by Shopify, you can visit https://privacy.shopify.com/en.
We will not discriminate against you for exercising any of these rights. We may need to verify your identity before we can process your requests, as permitted or required under applicable law. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.
Your Choices About Tracking and Advertising
Some tools on our site receive information about how you use the site and may use it for their own purposes, including advertising. Some state laws, including California's, may call this a "sale" or "sharing" of personal information. Most of these choices are run by the companies named, not by us. What each one offers may depend on where you live.
- Our opt-out page. If you are browsing from California, Colorado, Connecticut, Delaware, Florida, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah or Virginia, you can opt out on our Your privacy choices page. This list is correct as of the date at the top of this policy. The page may ask for your email address. It is part of our store and uses Shopify's privacy tools. It tells Shopify not to use your activity on our site for advertising. Your choice is saved for the browser you use. Other tools on our site may keep running after you opt out. These include Google Analytics, the Google & YouTube pixel, Microsoft Clarity, Klaviyo, Judge.me and the IP address lookups. For Google and Microsoft, use the choices below. We have no switch on our site for the others.
- Shopify. Use the Shopify Privacy Portal to opt out or to ask Shopify to delete your data.
- Google. Use the Google Analytics opt-out browser add-on (for Chrome, Safari, Firefox and Edge) and Google's ad settings.
- Microsoft and other ad companies. Go to the Digital Advertising Alliance opt-out page and choose Microsoft. Microsoft says this also opts you out of Clarity. The choice is saved for one browser at a time.
- Your browser. You can block or delete cookies in your browser settings.
- Our emails. Use the unsubscribe link in any marketing email we send you.
If you email support@smartivity.com, we can take you off our email list, ask Shopify to erase your customer details, and delete your form entries and your photo. If you have ordered from us, a record of the order stays, and Shopify may wait before it erases the details of a recent order. We keep what the law requires us to keep. This does not remove what the companies named in "Tools on Our Site" have already collected through their own tools. For Google, Microsoft and Shopify, use their links above.
Your California Privacy Rights
This section is for people who live in California.
What we collect
We collect contact details (name, email address, postal address, phone number), order and payment details, account details, what you send us in forms, messages and reviews (including photos), and device and usage details (IP address, cookie IDs, pages viewed, clicks, scrolling, mouse movement and your approximate location). The full lists are in "Personal Information We Collect or Process" and "Product Registration and Free Part Requests".
Who receives it
We disclose personal information to these kinds of companies: our store platform, which also handles payments and email (Shopify); analytics, session-recording and advertising companies (Google, Microsoft); a marketing tool (Klaviyo); our reviews app (Judge.me); cloud storage (Google Workspace); IP address lookup services (IPinfo, api.ipify.org and freegeoip.app); and fulfillment and shipping companies. The team that runs our site works from India and can also see it. More detail is in "How We Disclose Personal Information" and "Tools on Our Site".
Your requests
You can email us to ask what personal information we hold about you, or to ask us to correct or delete it. We will reply to every request.
To ask to see, correct or delete your information, email support@smartivity.com from the email address you used with us. We may ask you a question to check it is you. Someone you have authorized in writing can ask for you. We will not treat you differently because you asked.
To opt out, you can use our Your privacy choices page. It tells Shopify not to use your activity on our site for advertising. It may not switch off the other tools on our site. Its limits and your other choices are in "Your Choices About Tracking and Advertising".
Do Not Track and Global Privacy Control
Our site does not respond to browser "Do Not Track" signals. If you visit our site from California with the Global Privacy Control signal turned on, it is treated as an opt-out request for the browser you are using. It has the same limits as our Your privacy choices page, so other tools on our site may keep running.
Tracking by other companies
When you use our site, other companies may collect information about your online activity over time and across different websites. They are named in "Tools on Our Site".
Changes and effective date
If we make an important change, we post the new policy on this page with a new effective date. The effective date is at the top of this policy.
Shine the Light
California Civil Code section 1798.83 lets California customers ask, once a year and free of charge, what kinds of personal information a business gave to other companies for those companies' own direct marketing in the past calendar year, and who received it. Complaints
If you have complaints about how we process your personal information, please contact us using the contact details provided below. Depending on where you live, you may have the right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority.
International Transfers
The team that runs this site and answers customers works from India. Team members there can see customer information to do their work. We may also transfer, store and process your personal information outside the country you live in.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website, update the "Effective date" and "Last updated" dates and provide notice as required by applicable law.
